These Terms of Service ("Terms") apply to your use of the websites, assessments, programs, events, and communications offered by Aligned Solution Enterprises LLC, doing business as You Define Success ("You Define Success," "we," "us," or "our"). Our websites include youdefinesuccess.com, bizgutcheck.com, bizlaunch90.com, bizlaunchretreat.com, giftfromjen.com, nextrightmovecall.com, and any other site that links to these Terms.

By using our sites or services, you agree to these Terms. If you don't agree, please don't use them.

Who can use our services

You must be at least 18 years old to use our services or make a purchase.

Our services

You Define Success provides business coaching, training, programs, assessments, events, and related content for business owners. When you buy a specific program or service, any separate agreement or program terms for that purchase also apply. If those terms conflict with these Terms, the program agreement controls for that purchase.

Assessments and educational content

The Business Gut Check and our other assessments, results, videos, emails, and materials are for educational and informational purposes. They reflect our perspective on building a business and are not a professional evaluation of your business.

Not legal, tax, or financial advice

We are business coaches. Nothing we provide is legal, tax, accounting, financial, or investment advice. For those matters, consult a qualified professional licensed where you live.

No guarantee of results

Our programs are designed to help you make progress, and what you get from them depends on the work you put in, your circumstances, and factors outside our control. We don't guarantee any particular income, client, or business outcome. Any examples of other clients' results are not a promise or prediction of yours.

Purchases, payments, and refunds

Prices, payment plans, and refund terms are stated on the checkout page or in the agreement for each program or service. By completing a purchase, you authorize us and our payment processor to charge the payment method you provide, including scheduled payments on a payment plan. Unless a program's terms say otherwise, purchases are non-refundable.

Sessions and scheduling

If you need to reschedule a session, please give us at least 24 hours' notice using the link in your confirmation or by contacting us. Missed sessions without notice may not be rescheduled.

Email communications

By submitting your email address on one of our forms, you agree to receive the results or materials you requested and occasional emails from us. You can manage your preferences or unsubscribe at any time using the link in any marketing email.

Text messaging terms

Program. You Define Success text messages. If you check the box agreeing to receive text messages, we'll send you texts about appointments, programs, events, and updates from You Define Success.

Frequency. Message frequency varies.

Cost. Message and data rates may apply.

Opting out. Reply STOP to any message to stop receiving texts. You'll receive one final message confirming you've been unsubscribed. You can rejoin by signing up again.

Help. Reply HELP for help, or contact us at [email protected] or (971) 500-7036.

Consent not required. Agreeing to receive texts is not a condition of any purchase.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Privacy. See our Privacy Policy for how we handle your information. We don't share your mobile number or text messaging consent with third parties for their marketing purposes.

Intellectual property

Everything on our sites and in our programs, including text, videos, worksheets, templates, frameworks, logos, and graphics, belongs to You Define Success or our licensors and is protected by copyright and trademark law. You may use materials you purchase for your own business. You may not copy, resell, share, publish, or create courses or products from our materials without our written permission.

Acceptable use

You agree not to:

• Share your program login or recorded content with anyone else
• Record live sessions without permission
• Use our sites in a way that breaks the law or harms others
• Try to access accounts, systems, or data you're not authorized to access
• Harass or disrespect other participants in group programs or events

We may suspend or end your access if you violate these Terms.

Third-party tools and links

Our programs may use or recommend third-party tools, and our sites may link to other websites. We don't control those services and aren't responsible for them. Your use of them is governed by their own terms.

Disclaimer of warranties

Our sites and services are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent allowed by law, You Define Success will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of our sites or services. Our total liability for any claim will not exceed the amount you paid us for the service that gave rise to the claim in the 12 months before the claim.

Indemnification

You agree to hold harmless and defend You Define Success from any claims, damages, or expenses arising from your violation of these Terms or your misuse of our services.

Governing law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Multnomah County, Oregon, and you agree to the jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the effective date at the top. Continuing to use our sites or services after a change means you accept the updated Terms.
